These Terms of Service ("Terms") govern your use of the Spectre mobile application and website at spectre.sciphr.ca, operated by sciphr.ca ("we," "us," or "our"). Please read them carefully before using the service.
By downloading, installing, or using Spectre in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, do not use the service.
These Terms form a legally binding agreement between you and sciphr.ca. If you are using Spectre on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
Spectre is designed for genuine, in-person community sales events, including garage sales, estate sales, bake sales, lemonade stands, craft sales, and similar events at a physical address.

By posting a listing, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and reproduce that content within the Spectre app and website for the purpose of operating the service. You retain full ownership of your content.
You must not use Spectre to:
We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion and without prior notice.
The Boost feature allows you to pay to promote a listing, giving it priority placement in discovery feeds and a Featured badge for a set time period (24 hours, 3 days, or 7 days).
The Spectre name, logo, app design, codebase, and all underlying technology are the exclusive property of sciphr.ca and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the service without our express written permission.
As described in Section 4, you retain ownership of content you post. You represent that you own or have the rights to all content you upload, including photos, and that your content does not infringe any third party's rights.
If you provide us with feedback, suggestions, or ideas about the service, you grant us the right to use that feedback freely without obligation or compensation to you.
Spectre is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
To the maximum extent permitted by applicable law, we disclaim all liability for the actions, content, and conduct of third-party users.
To the maximum extent permitted by applicable law, in no event shall sciphr.ca, its operators, employees, or affiliates be liable for any:
Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) CAD $50.
Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless sciphr.ca and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
We may suspend or terminate your access to Spectre at any time, with or without notice, for any reason including but not limited to violation of these Terms or extended account inactivity.
You may delete your account at any time via Profile → Settings → Delete Account. Upon account deletion, your personal data will be removed as described in our Privacy Policy.
Provisions that by their nature should survive termination — including Sections 7, 8, 9, 10, and 12 — will survive any termination of these Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any disputes arising from these Terms or your use of Spectre.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via the app or email. Your continued use of Spectre after the effective date of revised Terms constitutes your acceptance of those changes.
If you do not agree to the updated Terms, you must stop using Spectre and may delete your account.
